1. Terms
StoryTourist is a mobile app, developed by Velodrom AB, that provides on-location exploration experiences. The concept is developed for users to explore a geographical area through storytelling both fictional and/or based on historical events. StoryTourist is also using gamification such as puzzle solving elements and/or interaction elements.
These terms and conditions are legally binding to your use of the Service however installed, accessed and/or used, whether via personal computers, mobile devices or otherwise.
By downloading and installing this application and accessing this Service you confirm that you have read and understood the Terms and any other documents referred to herein, including without limitation our Privacy Policy and that you agree to be bound by this Agreement.
If you want to use these services, you will need to have a registered account with us. The account may be automatically generated or manually created. You will also need access to a supported mobile phone and an Internet connection.
If you are the parent or guardian of a minor age 12 or older, you are agreeing to this Agreement on your behalf and on behalf of your minor(s) who you have authorized to use the Service pursuant to this Agreement. If you do not accept or understand the Terms, please do not use, download, access or register with the Service.
Based on these Terms:
- You are responsible for your account, including any charges and use of your account, whether by you or any third party.
- You are responsible for your safety and for complying with the law while using this Application.
- We use location-based technology to provide the Service, and your location may be tracked.
- We may, but have no obligation to, monitor user conduct on the Service. You are solely responsible for your conduct, the content you submit on the Service and your interactions with others.
2. Changes to the terms
These Terms will be updated from time to time. Make sure to review the Terms regularly to make sure that you are aware of any changes. If you continue to use the Service you accept any changes in the Terms or our Privacy Policy.
3. Eligibility and user accounts
This Service is intended for persons who are 13 years of age or older.
Using this Service may require registration of a StoryTourist user account. By creating or logging in to the account you agree:
- not to provide false or misleading information about yourself
- to update your information details so that it remains relevant
- not sharing your account information to third parties
- to take full responsibility of your account
- to notify us in case your account has been accessed by anyone not authorised by you.
We have the right to refuse registration for any reason. We have the right to suspend or delete your account, with or without notice due to negligence and/or violation of the Terms, for any other reason.
4. Safety
When using the Application, you must be aware of your surroundings. You use this Service at your own risk. You agree not to use the Service to violate any applicable law, rule or regulation.
Fees and Purchases. Certain features of the Service may be subject to a fee. Any applicable fees are displayed on the Service in connection with the respective feature of the Service. We do not warrant that feature specifications, pricing, or other content on the Service is complete, accurate, reliable, current, or error-free. In the event of any errors relating to the pricing or specifications, we shall have the right to refuse or cancel any orders in our sole discretion.
5. Third party material
The Service may contain links to websites and content owned and/or operated by third parties. Such links are provided for informational purposes only. We are not responsible for any such third-party websites or content and do not have control over any materials made available therein, including mobile phones and network availability. By accessing a third-party website or content you accept that we do not exercise any control over such websites or content. We encourage you to familiarize yourself with the terms of service applicable to any third-party website or content you may access. In particular, the Service may utilize Mapbox functionality and by accessing and using the Service, in addition to these Terms, you agree to be bound by the www.mapbox.com/legal/tos.
Please note that the applicable third party is fully responsible for the services it provides to you.
6. Cancelation policy
We do not have a cancelation policy since this is a digital tour that can be experienced at any time. But there might be circumstances that cannot have be foreseen. Therefore, you can ask for a refund if you notify us 24 hours in advance prior to when your booking was set. We also refund in case there are technical issues that has prevented you from doing the guided tour. To get in contact with us, use the following email: info@storytourist.com.
7. Geo-location
If you have enabled GPS, geo-location or other location-based features on your device, you acknowledge that your device location will be tracked and may be shared with others. The location-based services offered in connection with the Service are for individual use only and should not be used or relied on as an emergency locator system, used while driving or operating vehicles, or used in connection with any hazardous environments requiring fail-safe performance, or any other situation in which the failure or inaccuracy of use of the location-based services could lead directly to death, personal injury, or severe physical or property damage. Location data may not be accurate and the geolocated Service is used at your own risk.
By using the Service, you agree that we may access your device in order to allow for or optimize your use of the Service. For instance, the Game may access, use and read accounts, settings, data and/or content on your device, and/or add content to your device, and change settings of your device, for reasons such as saving Game images, sound files and writing usage logs to the device; sending social media messages you initiate; sending and receiving data needed for Service operations; and to provide you notice when you are not connected to a network. You consent to these activities by installing the Game or otherwise using the Service. You can disable all of them associated with the Game by uninstalling the Game.
8. Our intellectual property rights
These Terms confer only the right to use the Service. All rights, title and interest, including without limitation any copyright, patent, trade secret or other intellectual property right in the Service and all content existing or created in or through the Service will remain our sole property. You acknowledge and agree that Velodrom AB retains all right, title and interest in and to the Service and any content available therein. Subject to your compliance with these Terms, Velodrom AB grants you a limited, nonexclusive, non-transferable, non-sublicensable license to download and install a copy of the Apps on a mobile device and to run such copy of the Apps solely for your own personal non-commercial purposes. You may not reproduce, copy, modify, make the service available for multiple Users, distribute or exploit the Service in any unauthorized way.
9. Copyright policy
StoryTourist holds intellectual property rights in high regards. If there are any claims that StoryTourist is infringing on copyrighted material, whether it is content within the app or on www.storytourist.com, we strongly encourage you to reach out to us at info@storytourist.com.
10. Privacy and security
Your privacy and the protection of personal data about you are very important to us. For a detailed description of how we collect and use personal data about you, please see our Privacy Policy By using the Service, you consent and agree to the collection and use of certain information about you and your use of the Service in accordance with our Privacy Policy.
11. Liability
You access and use the Service at your own risk. You understand that the Service is provided to you on an “As is” and “as available” basis. We make no warranty that the Service will meet up to your requirements, or be available on an uninterrupted, secure or error free basis. We are not under any circumstances liable for any damages, claims, liabilities or costs that you may incur in connection with any content, products or services offered by any third parties we collaborate with.
12. Assignment
We may assign or delegate these Terms and/or our Privacy Policy, in whole or in part, to any person or entity at any time with or without your consent. You may not assign or delegate any rights or obligations under these Terms without our prior written consent, and any unauthorized assignment and delegation by you is ineffective.
13. Termination
We reserve the right to discontinue offering the Service or any part thereof, make changes to the Service, or to suspend, remove, modify or disable access to the Service at any time in our sole discretion and without notice. We may also, in our sole discretion, terminate or suspend your access to the Service and/or your User Account at any time. In no event will we be liable for the removal of or disabling of access to the Service or any part thereof. We may also impose limits on the use of or access to the Service, in any case and without notice or liability. Upon termination of the Service or a part thereof, your license to use the Service or a part thereof will be automatically terminated. In such an event, Velodrom AB shall not be obligated to provide refunds or other compensation to users in connection with such discontinuation. Following termination, all such terms that by their nature may survive termination of these Terms shall be deemed to survive such termination.
14. Terms applicable to location-based games
When using our Service, you are bound to the terms of Mapbox including the Mapbox Privacy Policy.
